Is a Structured Settlement a Lawsuit Award?

A structured settlement is NOT an award.  A settlement is a compromise

A settlement is a negotiated compromise

A structured settlement may be part of the compromise. There has to be a "meeting of the minds". There has to be an agreement.  The settlement agreement is a contract which may bar plaintiff from from seeking further compensation for their injury.

What is a Contract?

A contract is an agreement between parties, creating mutual obligations that are enforceable by law.

The basic elements required for the agreement to be a legally enforceable contract are:

1. mutual agreement, expressed by a valid offer and acceptance;
2. adequate consideration;
3. capacity and legality.

Why an Award is different from a Settlement in a Workers Compensation Case

"An award, on the other hand, is granted to you by the workers’ compensation court. A judicial decision after consideration; a judicial sentence.

Don't Some Settlements Require Court Approval?

Yes, some settlements do require a judge's approval. This is often the case when the settlement involves a minor, or a person under disability, or when a receiver is involved who has not been given authority to settle litigation without subsequent court approval. The court will review the settlement to ensure it is in the best interest of the estate, minor(s) or the person(s) under disability. That however, does not make them an award. What the judge is reviewing is the settlement compromise that has been negotiated between the parties to the settlement.

" Lead Plantiff Deadline"

The Class Action law firm  of Bragar Eagel & Squire, P.C lists a baker's dozen of new securities cases where there is a deadline for "lead plantiffs". One would hate to make a false equivalency of course, but a lead "plaintiff"is the individual whose name goes on the lawsuit and who represents the entire group of people who were allegedly harmed by the defendant’s (or defendants’) wrongdoing  Source: classaction.org.  Extending the rights of plants here as part of a "Green New Deal" is an innovative approach that may propel the law firm to  "Topiary of its Class".

Form found on the Beaver County website, to be submitted to prothonotary. lists "plaintiffs" who are "represented" by "Plantiff" lawyer. Plants and people litigating together. Things really need to be spruced up in Beaver. So "a-gnawing"    

The word prothonotary is recorded in English since 1447, as "principal clerk of a court".

Safe to say it's unlikely that anyone will beat Georgia's Henry County Judge Amanda R. JG Wentworth Jumps on The Baffling Them With Their BS Bandwagon

It's the Year of the Pig.  Tweets JG Wentworth on February 5, 2019, " according to Chinese astrology, 2019 (and technically part of 2020) is a great year to make money...JG Wentworth is the best place to start".

JG Wentworth, like its competitors, only offers a money losing solution. Trade your structured settlement payment rights for pennies on the dollar. For starters, JG Wentworth's solution could never be considered "making money".

 

S2 Knowledge Management Expert...Half Acid Washed Denham

Out of date information is of little use unless you are a historian, or perhaps a detective trying to solve a cyber crime.  This author has observed alot of detritus on structured settlements floating around like space junk.

One such example is the Wiki "KM in S2" produced by Patrick Hindert pal, Denham Grey. Download Kmwiki » KM in S2 4202009 . S2 is "geek speak" for structured settlements that hasn't gone mainstream (and probably never will). Denham Grey lists himself elsewhere as " working with my partner Patrick Hindert in the Structured Settlement industry". The KM in S2 Wiki contains much out of date information including many dead links, including links that this author opines were of little use in the first place, such as blog posts written by non expert pay per posters like Amit Laufer (a/k/a Cardinal Martini)

There are also incorrect links to  tax attorney Robert W. Wood, the Society of Settlement Planners and annuity issuers that no longer issue structured settlement annuities, dead links to factoring intermediaries, and the ubiquitous Hindert inspired factoring promotion of one hit wonder on structured settlements, asscociate professor "Adan (sic) Scales".

Denham Grey's "partner" Patrick Hindert became unglued the last time I provided constructive commentary about Grey's work on structured settlements two years ago, but the blight continues, "Denny" just won't clean up his room. It's time to hoover up this structured settlement flotsam and jetsam.
