What's the Difference between Plaintiff or Claimant, Defendant or Respondent?

What's the difference between a Plaintiff and a Claimant? 

Plaintiff and Claimant are legal and settlement terms that are often used interchangeably.  But we could be talking apples and oranges!

What is a Plaintiff?

A plaintiff is the person or entity initiating a lawsuit by filing a complaint in a court of law.

What is a Claimant?

A claimant is someone either bringing a case to court or more commonly, bringing a claim to his, her, their,  or the other side's insurance company.

What is a Defendant?

A defendant is a person or entity against whom an action or claim is brought in a court of law

What is a Respondent?

A respondent is the individual or entity that responds to a claim. Often refers to a pre-suit claim.

What is an Applicant?

An Applicant is the party that opens a case at the local Workers’ Compensation Appeals Board (WCAB) office by filing an application for adjudication of a Workers' Compensation claim

There are some important differences in structured settlement documents between cases in claim or suit.  Proper structured settlement documentation in settlement documents is crucial in order to achieve the goals of the settling parties. Non Qualified Structured Settlement Benefits Magnified By Tax Hikes

A deal reached in the New York State legislature will hike state income taxes by an astounding 31% for all New Yorkers making more than $500,000 a year reports Sunday's New York Post

A second, slightly lower tier would increase state income taxes by 14.5% for singles earning $250,000 to $500,000 annually and for married and joint filers earning $300,000 to $500,000. 

Tax increases increase the intrinsic value of non qualified structured settlements as a tool for resolution of employment cases (e.g. wrongful termination, sexual harassment, qui tam), divorce, structured attorney fees and other settlements which where a non qualified assignment may be used.

New York based celebrities, athletes, actors and actresses may have more incentive to structure their endorsement fees.

Other factors which should stimulate use of non qualified assignments are:

  • Inevitable federal tax increases
  • Proposed end to sliding scale attorney fees in medical malpractice cases in New York, if enacted.

  • New York Insurance Advertising law requires the full name of the Insurer to be listed along with the city and state of the principal office. Stating that you represent these fine companies using Insurance company logos without the preceding information are also illegal
  • When it comes to settlement documents it is the ultimate responsibility of the lawyers or claims adjusters who receive input concerning the structured settlement aspects of the documents to actually read the entire document, exercise independent thought and advise their clients properly
  • Be aware that financial advisors use of testimonials is prohibited or restricted
  • Most states require that Testimonials represent the CURRENT opinion of the person who made the testimonial. Be prepared to back it up.
