I've Never Thought of Spring as "Silly Season" But...

JG Wentworth is universally known for being a #cashnow company.  JG Wentworth is the undisputed 800lb gorilla of cash now for structured settlements. HOWEVER, cash now for structured settlements is a losing pennies on the dollar value proposition. So sell your structured settlements to JG Wentworth for pennies on the dollar and "let your savings bloom"?  What social media guru came up with that one and who were they targeting?

Would you give yourself a demotion?

Would you give yourself a demotion, a reduction in rank or status that means a significant reduction in salary to start a savings plan, in any season of the year?  Would you trust any sales person who pitched you with that?

Stone Street Deceptful Use of "Settlement Withdrawal" to Describe Structured Settlement Factoring

When legislators finally get around to a licensing standard for structured settlement factoring companies, Stone street capital settlement withrawal perhaps Stone Street Capital will become less brazen than using the term " Settlement Withdraw" to describe a pennies on the dollar structured settlement transfer.

"Structured Settlement - Settlement Withdraw" is how the Google paid ad looked at time of publication

  1. When you have a bank balance of $20,000 and want to withdaw $3,000 to pay your dentist for that root canal, post and crown, that is not covered by your dental insurance, you get dollar for dollar. You need $3,000 and you withdraw $3,000
  2. But when you go to Stone Street Capital you get nothing more than pennies on the dollar, so it's really not a withrawal is it? For the same $3,000 you would have to sell more than $3,000 to net $3,000.
  3. You cannot withdraw from your settlement.
  4. In fact there is a Structured Settlement Protection Act (SSPA) in each and every one of the 50 United States and the District of Columbia. A structured settlement factoring transaction is not a withdrawal. The immutable fact that court approval is required and that the structured settlement transfer acts refer to a transfer of structured settlement payment rights (NOT a withdrawal) flushes the slurry of Elsie's cow poo from Stone Street Capital, a JG Wentworth company, down the trough.

I will continue to document these sales practices of companies in the structured settlement secondary market so that state and federal legislators can continue to see examples of how structured settlement factoring companies disrespect consumers.  How hard is it to simply use the right terminology and make it a habit to do so?

The collective strategic failure of the majority of state legislatures to regulate the sales practices of structured settlement factoring companies has in some cases led to disastrous outcomes.

Stone Street Capital Canard "You Deserve Cash Sooner"

A recent Stone Street Capital Stone street capital retort to you deservead's premise is quite simple, if you don't read it literally.  They give you pennies on your structured settlement dollar and you "get the cash you deserve sooner".  That's supposed to be a fair deal? 
 
No "Stone Soul Picnic"
 
If you have a structured settlement don't fall for the grammatically challenged, capital letter missing on a personal pronoun Stone Street Capital sucker's play "Structured settlement i have - You Deserve Your Cash Sooner".  Think about what Stone Street Capital's marketing pitch literally says...
 
1. I (i.e. you) have a structured settlement
2. Someone other than you (the way it is written) deserves your cash sooner.  You see what they did? That's stone cold busted right there.
 

Most people who are receiving stable, income tax free structured settlement payments don't need to sell them for pennies on the dollar.  You can buy a lot of lollipops with what you save, Sweet!

Have a dollop of pennies on the dollar on JG Wentworth's word salad from the JG Wentworth website.

"One benefit of having a structured settlement is that you get long-term financial security in the form of a reliable stream of income. Even better, as the recipient of a structured settlement, you have the right to sell part or all of your overall payment stream in exchange for a lump sum—and that’s where JG Wentworth can help".  Yup, they really said that!

Long Term Financial security is a benefit of structured settlements admits JG Wentworth but if you sell your structured settlement payment rights to JG Wentworth (or anyone else) the most you will receive is pennies, just pennies on the dollar. JG Wentworth can help...help itself to your hard earned settlement money. And they say that's "even better"

If you can't figure out what is wrong with JG Wentworth's statement reread it again.

Legal Malpractice v Anapol Weiss Re 1986 ELNY Structured Settlement Settled With a Tax Twist

The legal malpractice lawsuit against Philadelphia personal injury law firm Anapol Weiss, arising from legal representation Concept of Human Capital in personal injury damages concerning a 1986 structured settlement, finally settled in March 2023. The compromise followed a pair of Motions in Limine by Defendants to Bar Plaintiff's tax expert, and to preclude evidence on tax liability, which was granted by  United States District Court Judge Karen M. Willams on Valentine's Day 2023. Had tax testimony been admitted it would have magnified the damages but might not have made the plaintiff any more whole. Instead, in settling, the parties focused on building a case for the damages being tax-free under the "human capital" concept set forth in O'Gilvie v  519 U.S, at 86.

The late Paul Anapol and/or his staff's unfortunate mistake on a "Recapitulation/Distribution Statement" in 1986, could've easily been avoided instead of becoming an example for the ages of what can go wrong when people are not paying attention to critical details.

It was a long and arduous road for Plaintiff Eric Nels Yerkes who, as a teenager on August 18, 1981, sustained "severe and permanent injuries in a plane crash near the Grand Canyon". Yerkes retained Anapol Weiss and its late founder Paul Anapol to bring a personal injury lawsuit.

"April Fools"?

Briefly, on the advice of his lawyers, Eric Yerkes entered into a structured settlement on April Fools Day (April 1, 1986), with Cessna Aircraft and its London market insurers. The settlement called for a cash payment of $125,000.00 and periodic payments of $1,000/month for  life, with increasing lump sum payments every 5 years. Cessna's insurers made a qualified assignment of their obligation to make future periodic payments to ELNY's assignment company, which funded the assigned obligation with an annuity from Executive Life Insurance Company of New York

The structured settlement was funded with an annuity from Executive Life Insurance Company of New York, at a time when contemporary prime time print and TV news media had observed severe financial impairments of two other similar annuity issuers and Executive Life had been dumped from the approved lists of major financial institutions for more than 24-36 months.  See my June 15, 2020 blog Lessons to be Learned from Eric Yerkes v Cessna and Yerkes v Anapol Weiss - Structured Settlements 4Real® Blog: Structured Settlements | Settlement Planning News and Commentary (typepad.com).

Five years later, in 1991, ELNY was under supervision of New York's insurance regulator. 22 years later, on August 8, 2013 ELNY was liquidated and restuctured into GABC. Thereafter, 1500 annuitants were set to receive up to 66% less than they were owed under their structured settlements. One of those was Eric Yerkes, whose payments were reduced to just 43.54% of their agreed upon amount.

Yerkes v Cessna et al. is the Seminal Case for Insurers' Novation under Qualified Assignments

Yerkes' attempt to recover from Cessna and the London market insurers failed, due to Yerkes having already released them from the perioidc payment claim when the qualified assignment went into effect, in 1986. Yerkes v Cessna and Underwriters at Lloyds, became a seminal case for novation under a qualified assignment. Most insurers will not enter into a structured settlement without a qualified assignment.

Yerkes Then Turns Turrets on Former Law Firm

On April 12, 2017 Yerkes then went after his lawyers Anapol Weiss for legal malpractice based upon, among other things, alleged lawyer representations made in alleged communication with Yerkes about Cessna's and the London underwriters' ongoing (post qualified assignment) responsibilities that were incorrect. In connection with the with the Cessna Settlement Agreement, Despite the fact that there was a qualfied assignment, Yerke's lawyers provided him with a "Recapitulation/Distribution" statement stating that under the Cessna Settlement Agreement " All Periodic Payments Guaranteed to Eric N. Yerkes by The Cessna Aircraft Company" and "The Total Payout, Assuming a 59 Year Life-Expectancy is  $6,668,000.00" of which  all but $468,000.00 is Guaranteed by Cessna"  

The Parties Disagreed Whether Yerkes' Recovery in the Legal Malpractice Case Would Be Taxable

Defendants had submitted Motions in LImine (1) Barring Testimony of Plaintiff's expert on Taxes (ECF No. 159) and (2) To Preclude Evidence of Tax Liability  (ECF No. 160)

Direct Causal Link

"In order for the exception provided by Section 104(a)(2) to apply, a movant must show that there is " a direct causal link between the damages and the personal injuries sustained"   Blum v Commissioner of Internal Revenue, No. 20020-17, 2021 WL 6323- at *7-8 (T.C. Feb. 18, 2021)

Nature of the Claim

" When damages are received pursuant to a settlement agreement, the nature of the claims that was the actual basis for the settlement controls whether the damages are excludable under section 104(a)(2)" See Burke v Schleier  504 U.S. at 237

"The nature of the claim is derived from the terms of the agreement".  See Rivera , 430 F 3d at 1257

"If the agreement is unclear, " the intent of the payor" is pertinent to examine, taling into account consideration for the amount paid, the factual circumstances leading to the settlement, and the allegations

In this case Plaintiff was awarded damages for severe and permanent injuries, and the intent of the parties has been clear throughout the matter, in mulriple filings from both Plaintiff and Defendant, that the Comtemplated Settlement Agreement is not to simply settle a malpractice claim, but to substitute Plaintiff's awarded damages, which were drastically reduced due to ELNY's restructuring, with the contemplated settlement here, The parties have made it crystal clear that they are settling the case for he sole purpose of returning Plabitiff's human capital (in the form of damages) to make him whole  (ECF No. 190 at Exhibit A)

The Yerkes Court found that it is clear from the Contemplated Settlement Agreement, as well as the consistent characterization of Plaintiff's potential recovery as one of recovering for physical injury throughout the litigation, the Court is satisfied that the paramount reason for the settlement is to compensate the Plainiff for the  physical injuries he suffered in the 1981 plane crash.

The Court's further found that the Contemplated Settlement Agreement is "in lieu" of the plaintiff's human capital that was lost in the 1981 plane crash, as the Contemplated Settlement Agreenment is intened to be a one-to-one replacement of the damages awarded to Plaintiff from his original suit alleging physical injury.

The Court further found that this Opinion stays faithful to the principle of "human capital" rationale that emanates from Section 104*a)(2) as instructed by the   Supreme Court in O'Gilvie  519 U.S.  at 86

John Darer Reviews JG Wentworth "Poached Egg Special"

JG Wentworth is apparently running a "poached egg" special JG Wentworth poaches CBC settlement funding cash now

Why would a JG Wentworth ad include the name of one of its competitors on March 2, 2023?  Was there a merger or acquistion? Apparently no.  I contacted CBC Settlement Funding moments before posting to confirm that CBC Settlement Funding and JG Wenworth are separate companies and that JG Wentworth does not own CBC Settlement Funding. Perhaps JG Wenwtorth is throwing in a blood test  [CBC=Complete Blood Count].

This revelation comes just a day after we highlighted Peachtree Financial, a JG Wentworth company, calling itself a "structured settlement broker" as we honored Annuity.org with The Structured Settlement Canard of the Month.

In a week in which it has been observed highlighting its settlement "intersectionality" ** via Google Adwords, Peachtree Financial urges dreamers with structured settlements, "Don't Just Dream About Remodeling Your Home Or Paying Off Debt. Get A Lump Sum of Cash! You're Waiting For Your Structured Settlement Payments. Get Started"

Translation  Don't Just Dream About Selling Your Structured Settlement For Pennies on the Dollar to remodel your home!  Sell your structured settlement payments to Peachtree Financial for pennies on the dollar to remodel your home.

Say it costs $25,000 to remodel your kitchen, you're going to have to sell more income payments, or more of a lump sum than you need to raise that cash.  Do you think that makes a whole lot of sense?

JG Wentworth and Peachtree Financial Now Each Identify As "Settlement Consultants"?

In a shocking discovery, twice bankrupt JG Wentworth and its sister company Peachtree Financial now apparently each identify as a " Settlement Consultant" as this May 12, 2021 screenshot shows.  It's not clear how long the the Chesterbrook Pennsylvania companies' secondary market "dysphoria" has been building.

Does providing advice about a "pennies on the dollar" value proposition rise to the level of settlement consultant?

In "What is a Structured Settlement Consultant and Why Do You Need One?", published  April 1, 2020, Independent Life's Patrick Hindert, co-author of a seminal industry text book lays out the typical services offered by settlement consultants. Upon information and belief neither JG Wentworth nor Peachtree offers any of the services Hindert mentions.

The National Structured Settlements Trade Association owns the registered trademarks for:

  • Certified Structured Settlement Consultant (CSSC)
  • Master Structured Settlement Consultant (MSSC)

Upon information and belief one would be hard pressed to find anyone associated with JG Wentworth or Peachtree that has earned either professional designation. 

The fledgling American Association of Settlement Consultants (AASC) now has to contend with this sticky wicket. Does diversity and inclusion include JG Wentworth and Peachtree now that they each identify as settlement consultants?

An Annuitant, a Measuring Life, a Payee and a Beneficiary Walked Into A Bar and they Each Ordered a Beer. The question is how many beers does the bartender pour?

The solution to this structured settlement definition quandry is no different than that for someone seeking a solution to incontinence. Depends

What is an Annuitant?

The individual named under an annuity contact who will serve as the measuring life for the purposes of determining the benefits to be paid under a structured settlement annuity contract

What is a Measuring Life?

The human being or natural person whose life expectancy is the basis for the cost of a structured settlement annuity that is payable for life.

What is a Payee?

The individual or entity to which payments are due to be made under the structured settlement annuity contract

What is a Beneficiary?

The individual(s) or entity that is (are) due to receive a death benefit when the Measuring Life for a structured settlement annuity dies.

It's critical to note that in differing circumstances two or more of these could be the same individual or entity. The Bartender must pour a minimum of 2 beers because the annuitant, measuring life and payee could be one and the same. If that were the case they could not be the beneficiary.

Structured settlement brokers, settlement planners and their staffs, post-sale handlers at life insurers and lawyers,  have a responsibility to see that these are reflected accurately in structured settlement documents such as the Settlement Agreement and Release, Qualified Assignment, Annuity Contract, Pledge Agreement) if Applicable and Guarantee.
