JG Wentworth and Peachtree Financial Now Each Identify As "Settlement Consultants"?

In a shocking discovery, twice bankrupt JG Wentworth and its sister company Peachtree Financial now apparently each identify as a " Settlement Consultant" as this May 12, 2021 screenshot shows.  It's not clear how long the the Chesterbrook Pennsylvania companies' secondary market "dysphoria" has been building.

Does providing advice about a "pennies on the dollar" value proposition rise to the level of settlement consultant?

In "What is a Structured Settlement Consultant and Why Do You Need One?", published  April 1, 2020, Independent Life's Patrick Hindert, co-author of a seminal industry text book lays out the typical services offered by settlement consultants. Upon information and belief neither JG Wentworth nor Peachtree offers any of the services Hindert mentions.

The National Structured Settlements Trade Association owns the registered trademarks for:

  • Certified Structured Settlement Consultant (CSSC)
  • Master Structured Settlement Consultant (MSSC)

Upon information and belief one would be hard pressed to find anyone associated with JG Wentworth or Peachtree that has earned either professional designation. 

The fledgling American Association of Settlement Consultants (AASC) now has to contend with this sticky wicket. Does diversity and inclusion include JG Wentworth and Peachtree now that they each identify as settlement consultants?

  • New York Insurance Advertising law requires the full name of the Insurer to be listed along with the city and state of the principal office. Stating that you represent these fine companies using Insurance company logos without the preceding information are also illegal
  • When it comes to settlement documents it is the ultimate responsibility of the lawyers or claims adjusters who receive input concerning the structured settlement aspects of the documents to actually read the entire document, exercise independent thought and advise their clients properly

  • Most states require that Testimonials represent the CURRENT opinion of the person who made the testimonial. Be prepared to back it up.
