Misleading advertising by structured settlement factoring companies and industry lead generators has led to confusion in those who give testimonials to such organizations. Take these two testimonials for Strategic Capital, a Toronto based company that solicits US citizens, from trial lawyer associations to whom Strategic Capital has made a generous financial donation. They were posted by Strategic Capital to its Facebook page on November 24, 2020.
Kentucky Justice Association got it wrong
Strategic Capital posted: “Strategic Capital is an annuity purchase organization that operates in a principled fashion and treats clients compassionately and fairly.” -Kentucky Justice Association
New Jersey Association for Justice got it right
Strategic Capital posted: “Strategic Capital Corporation purchases structured settlement payments. Unlike other firms in the industry, they are known for treating, with care and fairness, those with severe financial challenges arising after their case has settled.” -New Jersey Association for Justice
So what is wrong?
I strongly suspect that Strategic Capital would not be able to demonstrate it has actually purchased a structured settlement annuity from any client of a member of the Kentucky Association for Justice. The lack of understanding shown by the author of the statement attributed to the Kentucky Association for Justice in is one thing. The deliberate use of the misleading testimonial by Strategic Capital, knowing that they do not and cannot buy structured settlement annuities is something else.
As the New Jersey Association for Justice correctly attributes, when it comes to clients of members of the trial lawyer associations that Strategic Capital donates money to, Strategic Capital buys structured settlement payments ( or specifically structured settlement payment rights).
Why should anyone care?
False information needs to be stopped dead in its tracks. Some structured settlement factoring companies who buy structured settlement payment rights re-sell or assign the payment rights to investors mislabeling them annuities. Investors have lost money, even all their money. Factored structured settlement payment streams are not annuities. The risks of such investments have come into sharper focus in past, as well as ongoing litigation against competitors of Strategic Capital. Strategic Capital and other structured settlement factoring companies need to do a better job in scrutinizing what they publish. Could they not simply ask the Kentucky Justice Association to rewrite the testimonial so it is technically correct instead of publishing and hoping nobody notices?
