Zelek's company claims to be "dedicated to helping you understand annuities and structured settlements better". They fail time and time again.
Annuity.org has been a lead generator for Conshohocken PA based CBC Settlement Funding and more recently, Atlanta Georgia based Fairfield Funding. These factoring companies, whose main value proposition is to pay unsophisticated people pennies on the dollar are shameful for supporting the virus of illiteracy propagated by Zelek's company on the subject.
Catherine J. Byerly is, by some distance, the worst of the worst writers about structured settlements on the Annuity.org staff, in my opinion. Over the years, Byerly's writing about structured settlements shows extremely poor research skills supported by incompetent fact checking by editorial staff of Zelek's company. The posting that Annuity.org content "is meticulously reviewed to ensure it meets our high standards for readability, accuracy, fairness and transparency", is outrageous.

A. If a case goes to trial, there could be a jury trial, or a bench trial. If there is a jury trial. it is the jury who makes a decision or findings of fact.The judge will determine any questions of law. A bench trial is a trial in which a judge (or panel of judges) makes all decisions.
B. A settlement is compromise. The parties must have a meeting of the minds. A judge cannot force a party to settle. Parties settle for their reasons.
3. Byerly The qualified assignee purchases an annuity from a life insurance company, setting up the annuity contract to match the settlement needs.
