Aviva group ratings affirmed by Standard & Poors on strong business fundamentals

Following the S&P announcement on October 28, 2008 the following was released by Tom Godlasky, CEO of Aviva USA.

“Today’s interim management statement and reaffirmation of Aviva plc’s AA/AA- rating from
S&P confirm that our capital position, asset base and diverse businesses leave the company
strongly positioned both operationally and financially. Our distribution partners, policyowners and investors can be confident that our prudent approach to managing our business remains in alignment with their interests regardless of market cycle.”

Aviva plc is the fifth-largest global insurer, operating general insurance, long-term savings and
investment management businesses around the world. Aviva Life and Annuity Company and Aviva Life and Annuity Company of New York are its structured settlement annuity issuing companies. Aviva had its AM Best rating reaffirmed at A+ (Superior) on September 19, 2008.
