Like it or not, pursuant to CF 50.24 an annuity broker must declare in writing, under penalty of perjury and subject to the federal perjury statute, that he/she has provided substantial structured settlement services to or on behalf of defendants or their counsel in each of the last 3 years.
The founder of High Impact Structures, LLC, which heavily advertises to the American Association for Justice, The Colorado Trial Lawyers Association and other state TLAs, appears to be impaled on the same type of "mutually exclusive" stake that John T. Bair and Forge Consulting find themselves on. To be on the list John S. Bat would have had to sign the declaration under penalty of perjury. Holy Bars of Soap Batman!
Why brokers would jeopardize their careers to make such statements defies logic. Who in the industry has the balls to stand up to prevent the few from affecting our industry credibility?

Further guano from "the Bat Cave", "National Structured Settlement trade Association statistics show that 92% of claimants accepting a lump sum settlement have spent all the money within 5 years, and I find this statistic completely unacceptable, and an embarrassment to the industry as a whole." John S. Bat on High Impact Structures, LLC website
Not true. NSSTA has never issued such statistics. Moreover, an oft cited 1992 publication by The Rutter Group, Ltd.,cited as Flavahan, Rea, Kelly & Tener, California Practice Guide: Personal Injury (TRG 1992) Chapter 4 used 90% in 5 years.
