The Structured Settlement Affidavit is a series of affirmative representations and warranties issued in writing for any case on which we are involved. These certify among other things that we:
- Do not pay commission rebates to any party or insurer, or evade the anti-rebating statutes through "service fee" or "administrative fee" arrangements
- Fully disclose age ratings and never misrepresent the cost of a structured settlement by engaging in post settlement medical underwriting
- Always disclose the true cost of the structured settlements that we participate in or negotiate and do not attempt to artificially inflate the value of any settlement by using unrealistic present value calculations
- Are not an "in house" or captive broker owned or controlled by an insurance carrier
When it comes to structured settlements there's nothing like full dislosure to put your clients and adversaries at ease so that everyone can get to the constructive part of the deal. Occasionally I get push back from co-brokers when I ask them to sign and I can't understand why if they have nothing to hide.
In the New York City Metropolitan area I am pleased to report that we have three structured settlement consultant or structured settlement annuity brokerage firms who now use some form of the Structured Settlement Affidavit (4structures.com, LLC), Certificate Of Reliability and Assurances(Creative Capital, Inc.) or Guaranty of Integrity (Sam Senders of EPS).
