  • The use of the NSSTA Financial Security Hand Out by Structured Settlement Brokers and Settlement Planners With Plaintiffs or Attorneys in New York May Violate The Law
    The New York State Insurance Department Office of General Counsel opined in January 2009 that the fact that the brochure generally discusses guaranty funds is irrelevant and where aimed at New York residents is unlawful. A number of other states have similar prohibitions.

  • When it comes to settlement documents it is the ultimate responsibility of the lawyers or claims adjusters who receive input concerning the structured settlement aspects of the documents to actually read the entire document, exercise independent thought and advise their clients properly
  • If you advertise that you are "plaintiff exclusive" then you cannot logically be on the USDOJ list of annuity brokers. If YOU elect to proceed, choose your punishment...perjury or false advertising!
  • Be aware that financial advisors use of testimonials is prohibited or restricted
  • Most states require that Testimonials represent the CURRENT opinion of the person who made the testimonial. Be prepared to back it up.

Settlement Consultants Who Have Made Structured Settlement Declaration on Factoring Business Practices

Established in December 2007, the purpose of the Structured Settlement Transparency Initiative is to help tort victims. their lawyers, judges and other stakeholders distinguish those vendors, including structured settlement brokers, settlement planners and litigation recovery management product providers for tort victims, who have willfully separated themselves from the practice of structured settlement factoring compensation, selling of structured settlement payee names to "cash now pushers" or their agents and certain related business practices, by some of those in their industry, by having signed a declaration under penalty of perjury that, as of the date he or she signs, he or she DOES NOT:

  1. take, nor plan to take, any compensation of any form for referrals to companies that broker, or fund structured settlement factoring transactions;
  2. sell, nor intend to sell lists of names of structured settlement annuitants to companies that broker, or fund, structured settlement factoring transactions;
  3. provide, nor intend to provide, structured settlement documents to factoring companies.

It has been proven that the taking of compensation for structured settlement factoring by structured settlement brokers only serves to reduce the bottom line of tort victims who are in an already desperate situation. If there is no disclosure of the business practice, the tort victim has no ability to negotiate the cost of services provided (if any) in good faith.  Those who take compensation may do little more than make a referral.

There is also a substantial benefit for ALL parties, including defendants, defense lawyers and insurers, to know that negotiated confidentiality provisions will not be compromised by third party vendors retained by them or their adversaries.
