"Don't Wait For Your Money" screams the headline on the Rescue Capital website. "Sell Your Structured Settlement and Annuity Payments For Cash" it continues unambiguously. But for the fact that Rescue Capital has ties to Michael A. Upchurch, the CEO of Delta Company of Insurance Services Inc. (a/k/a Delta Settlements), a company that advertises that it places over $250 million of structured settlement and annuities, there would be no need to question sheer hypocrisy.
Consider these "conflicting" statements which appear on the Delta Settlements website or blog as of today April 6, 2012:
"Structured settlements are a powerful financial planning tool and are the cornerstone of most financial settlement plans" 4/6/2012
"Failing to offer a structured settlement or preserve public benefits can have disastrous consequences for the plaintiff and ultimately result in a claim against plaintiff counsel". 4/6/2012
"By having a waiver signed, we help protect counsel from claims stemming from failure to offer a structure..." 4/6/2012
Resolving an injury or wrongful death case with a tax-exempt structured settlement annuity not only provides guaranteed payments, but also maximizes the returns". 1/6/2012
"Published in the Defense Research Institute’s October issue of For the Defense, the American Bar Association (ABA) President, William T. Robinson III, describes a specific case wherein a structured settlement was used. Describing his representation of a terminally ill client, Mr. Robinson’s article exhibits how a structured settlement provided the peace of mind and security his client desperately sought" 12/12/2011

How can Upchurch justify supporting placing people into structured settlements and running an agency that places people into structured settlements at the same time Rescue Capital, a company to which Upchurch has ties, screams the solicitation "Why Wait" for structured settlements?
There is just nothing about "Why Wait?" that can be explained away as passive marketing.
