In 2009 WalMart settled a class action law suit filed in Clinton County, Iowa, resolving an action about Fair Labor standards for its Iowa employees for $11 million. Here is the newspaper report about the law suit in which one of the lead plaintiffs was Sally Mussman.
According to the newspaper report,the terms of the settlement forbid lawyers from commenting about it which perhaps explains why there is no website or better communication than appears to have been made.
From what I can deduce based on the massive amount of calls I've personally received, settlement checks were distributed in 2010 and in 2011 those distributees received W-2s.
Many of these poor souls were confused first by the check and second by the W-2. Many people that have called us claim not to have received a check. It is possible that have moved, got married, changed names It is a huge frustration for them.
I write this blog post out of both empathy and exasperation. There is no financial gain in this for me. People are calling concerned about identity theft, concerned about tax penalties (because they don't know what a W-2 is) and some demonstrate a total lack of reading comprehension. I have had spent literally hours of uncompensated time doing the job that lawyers and administrators of the Mussman Qualified Settlement Fund and Iliasis Qualified Settlement Fund should be doing.
I write this letter in particular for Ms. BeverlyMiller who called me from the 641 area code and clogged up my voicemails with 7 calls on 1/31 at 605pm and 2/1 /2012 at 1054am, 1102am, 1113am, 1143am, 1156am, 12pm. Bev, no offense but I'm not calling you back. Read the blog posts dear.
For those lawyers who attend Mass Torts Made Perfect, as good as you may be, I hope you will share this with your colleagues to see an example of what not to do and/or how to make it better for the claimants who make piddly but on whose backs you've derived millions of dollars in legal fees.
