    Advertising That Just Ain't Right

      A number of settlement planners suffer from "shrinkage". You shouldn't!
    • "Cash Now"-The New Crack?
      Is "cash now" the new crack? Sure seemed like it for a while with advertising that dangles "financial cat nip". Problem is they cannot DELIVER "cash now" making it fraudulent advertising. List of "cash now" pushers
    • "Registered Settlement Advisor" Fake or Real?
      David Snyder, former President of Delta Settlements was called out on this "fictitious" designation that was used in the solicitation of insurance products. I've scoured the Internet and can't locate any evidence that this is an ACCREDITED professional designation. Snyder has retired and the company has been sold but at least the new ownership created a website without the bogus designation. One industry blogger deemed the above revelation as reminiscent of Senator McCarthy. We call it cleaning up the structured settlement industry. There is no excuse for using bogus credentials.

    Structured Settlement Best Practices Corner

    • The use of the NSSTA Financial Security Hand Out by Structured Settlement Brokers and Settlement Planners With Plaintiffs or Attorneys in New York May Violate The Law
      The New York State Insurance Department Office of General Counsel opined in January 2009 that the fact that the brochure generally discusses guaranty funds is irrelevant and where aimed at New York residents is unlawful. A number of other states have similar prohibitions.
    • New York Insurance Advertising law requires the full name of the Insurer to be listed along with the city and state of the principal office. Stating that you represent these fine companies using Insurance company logos without the preceding information are also illegal
    • If You Are the Structured Settlement Broker For the Primary Insurer and Your Client Is in A Policy Limit Situation, don't imply to the plaintiff lawyer that you or your Company represents the Excess Carrier Unless (1) you actually do AND are appointed on the file (2) You have authority from THE EXCESS CARRIER To Engage the Plaintiff Attorney. If you do not have such authority and represent or imply that you do, you not only compromise the carrier's position, but you bring your trustworthiness, and that of your company, into question. You also bring shame on the industry which should not be tolerated
    • When it comes to settlement documents it is the ultimate responsibility of the lawyers or claims adjusters who receive input concerning the structured settlement aspects of the documents to actually read the entire document, exercise independent thought and advise their clients properly
    • If you advertise that you are "plaintiff exclusive" then you cannot logically be on the USDOJ list of annuity brokers. If YOU elect to proceed, choose your punishment...perjury or false advertising!
    • Be aware that financial advisors use of testimonials is prohibited or restricted
    • Most states require that Testimonials represent the CURRENT opinion of the person who made the testimonial. Be prepared to back it up.
    • Number of States That Prohibit Payment of QSF expenses by licensed agents and brokers

    Patrick Hindert Promotes Structured Settlement Factoring and is Chummy With JG Wentworth But Appears That He Won't Help Tort Victim...WHY?

    The structured settlement industry torch bearer for the factoring of tort victims' structured settlement payments, Patrick Hindert, still appears to have not responded to the call for assistance from tort victim J. Henry who posted on Hindert's blog on August 28, 2008. WHY? We know Hindert reads his blog because he posted just this morning on another subject. Moreover Typepad, Patrick Hindert's blog vendor would have also sent Patrick Hindert an email alert to Henry's dilemma on August 28, 2008.

    That leaves the poor tort victim to call around and around and exposed to abuse.

    On August 29, 2008 I posted Where is Hindert when Annuitant Goes To Well For Second Time And Seeks Factoring Expert?

    Whether or not it would be advisable for J. Henry to factor is another story.
